1.1 Please carefully read the following Terms & Conditions before using the www.scottishfamilyties.co.uk website. By accessing this site, you agree to be bound by these Terms & Conditions. These Terms & Conditions may be updated from time to time. Accordingly, you should check the date of the Terms & Conditions (which appear at the end of this document) and review any changes since the last version. If at any time you do not agree to these Terms & Conditions, please do not use this Site.
1.2 Please note nothing in these Terms & Conditions affect your statutory rights as a consumer.

Security
2.1 To allow you to pay by credit or debit card, SCOTTISH FAMILY TIES use WorldPay. WorldPay is part of The Royal Bank of Scotland Group, one of the world’s largest banks. When you reach the page for entering your card information, you are connected directly to the WorldPay secure server using state-of-the-art Secure Sockets Layer (SSL) encryption technology. SCOTTISH FAMILY TIES does not retain your credit or debit card details on our systems.
2.2 SCOTTISH FAMILY TIES has implemented security measures to protect the personal information you provide against unauthorised access and use.
2.3 Please be aware, however, that no data transmission over the internet is absolutely 100% secure and any information disclosed online can potentially be collected and used by persons other than the intended recipient.

Privacy

Pricing
5.1 SCOTTISH FAMILY TIES reserves the right to revise prices and details at any time without any notice. All items are subject to availability. If for any reason we are unable to supply a particular tie, we will notify you as soon as possible so that you may choose to modify or cancel your order.
5.2 The price of goods stated in this website are correct at publishing, however, we reserve the right to refer to our retail price list as the definitive pricing document and accept orders based on the condition that the two sums correspond.
5.3 All transactions are in British Pounds Stirling (£). Other currencies optionally displayed while shopping are approximate and advisory only. The prices include VAT (value added tax) which has a current rate of 20.00%. Delivery charges are additional and will be calculated automatically then added to the total price payable before you confirm your order. Payments using the following credit and debit cards are accepted: Visa, MasterCard, Maestro, JCB and Visa Electron. All credit and debit are subject to validation and authorisation by the card issuer.
5.4 Please be advised that orders delivered outside the EU may be subject to local taxes, import duties or customs charges. Unless otherwise stated all overseas packages are ‘Delivered Duty Unpaid’. SCOTTISH FAMILY TIES is unable to accept responsibility for charges levied by other countries. Please ensure that you are aware of any additional import charges before ordering. If you are unsure you should contact your local customs office.

Acceptance
6.1 All orders placed by you are subject to our acceptance. SCOTTISH FAMILY TIES reserve the right at all times and at our sole discretion to refuse to accept an order for any reason and without liability to you.

6.2 After you have placed an order with SCOTTISH FAMILY TIES, we will send you an acknowledgement by e-mail with your order number and details of the product you have ordered. This e-mail is only an acknowledgement of receipt and is not an acceptance of your order. The acceptance of your order and a contract of sale between us will not take place until you have been advised the said goods are available and these goods have been paid for in full including any applicable charges. No payment shall be considered to have been received until we have received payment in cleared funds.

Delivery
7 SCOTTISH FAMILY TIES reserve the right to a full 30-day delivery but in practice this is most unlikely. We intend to deliver our customers ties as soon as possible. If we do not deliver your goods within the times we have specified, you are entitled to cancel your order. Alternatively you may agree to a revised delivery date with us. Statutory Rights
8 Your rights to return goods are protected under the EU Distance Selling Directive, which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm By law, customers in the U.K. and the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item was delivered. This cooling off period ends seven days after the day the item was delivered.

Cancellations
9.1 You may cancel your order for any reason whatsoever at any time from the day after you placed it up to 7 working days from the day after the date you receive it, provided you have not used and/or damaged the item in question.
9.2 To cancel your order please provide SCOTTISH FAMILY TIES with notice: either call us on +44 (0) 1343 549008 (Monday – Friday 0900-1700 GMT) or notify us by email on cancellation@scottishfamilyties.co.uk or in writing to: Scottish Family Ties 42 Muirfield Road Elgin Scotland IV30 6DE, giving order number and details of item ordered. In each case within 7 days from the day after on which the item in question was delivered.
9.3 SCOTTISH FAMILY TIES will reimburse any money including delivery postage you have paid for the goods you do not want within 30 days from the date you notify us of the cancellation provided that the goods have been returned to us unused and undamaged. It is your responsibility to take reasonable care of the goods while in they are in your possession, and to return the goods to us as soon as possible, either in the original packaging or something suitably protective. We strongly advise you to obtain proof of postage. We will not refund the cost of this return postage.
9.4 When returning goods it is the responsibility of the customer to insure the goods arrive safely, please reuse the original packaging or something suitably protective. Enclose the dispatch note giving the reason for the return, clearly stating whether you require a refund or exchange. Return the package to: Scottish Family Ties 42 Muirfield Road Elgin Scotland IV30 6DE and please remember to obtain a 'Proof of Posting Certificate' for your protection.

 Faulty or misdescribed items
10.1 We take great care to ensure that you receive your goods in perfect condition; each order will have been thoroughly inspected before we dispatch it. However, if you find that there are faults or damage, or we have sent the wrong items please notify us either: call us on +44 (0) 1343 549008 (Monday – Friday 0900-1700 GMT) or notify us by email on CustomerAssistance@scottishfamilyties.co.uk or in writing to: Scottish Family Ties 42 Muirfield Road Elgin Scotland IV30 6DE, as soon as possible. Provided upon inspection the item in question is accepted as returned goods you may reject the goods and receive a full refund or request a replacement. The postage cost of you returning such goods to us will be refunded.
10.2 SCOTTISH FAMILY TIES reserves the right to refuse a refund or exchange if upon inspection the goods returned are deemed to have been damaged or tampered with.
10.3 When returning goods it is the responsibility of the customer to insure the goods arrive safely, please reuse the original packaging or something suitably protective. Enclose the dispatch note giving the reason for the return, clearly stating whether you require a refund or exchange. General
11.1 Colour accuracy on the website cannot be guaranteed, and will vary depending on the resolution and screen type of your computer, therefore actual products colours may vary from those displayed. These are technical reasons beyond our control.
11.2 As our handmade products are generally randomly cut they can therefore be subject to some variation from the pattern shown on the site.
11.3 All material on the SCOTTISH FAMILY TIES website (drawings, written text and imagery) are the exclusive property of SCOTTISH FAMILY TIES, and are subject to standard copyright provisions. The site may not be altered in any way or republished without permission.
11.4 All matters concerning and incidental to any offer or agreement for the purchase and sale of goods from SCOTTISH FAMILY TIES shall be governed by Scots Law.
11.5 SCOTTISH FAMILY TIES reserves the right to refuse to supply any individual or company.
